Implikasi Kebijakan Pengadilan Pidana Internasional: Investigasi Pelanggaran Agresi Militer Israel Di Jalur Gaza, Palestina

Abstract


Tulisan ini mengkaji konflik Israel-Hamas yang sedang berlangsung dan menyoroti tuduhan pelanggaran Hukum Pidana Internasional yang serius oleh militer dan otoritas politik Israel. Konflik ini, yang telah lama dibayangi oleh ketegangan historis dan sengketa teritorial, kini berada di bawah penyelidikan Pengadilan Kriminal Internasional (ICC) terkait dugaan kejahatan perang dan kejahatan terhadap kemanusiaan di Gaza sejak tahun 2014. Meskipun Israel bukan anggota ICC, yurisdiksi pengadilan ini mencakup wilayah Palestina, yang telah menjadi pihak dalam Statuta Roma sejak 2015. Penyelidikan ini diperkuat oleh tekanan internasional dari negara-negara anggota dan non-anggota ICC, yang menyerukan pertanggungjawaban atas serangan terhadap warga sipil Palestina pada 7 Oktober 2023. Artikel ini mengeksplorasi dimensi hukum, politik, dan etika dari keterlibatan ICC, serta implikasi potensial bagi upaya penegakan keadilan global dan perlindungan hak asasi manusia di Gaza. Di tengah berbagai tantangan hukum dan geopolitik, artikel ini berargumen bahwa penyelidikan ICC dapat menjadi titik balik dalam memperkuat akuntabilitas pelaku kejahatan dan memberikan harapan baru bagi para korban di salah satu konflik paling kontroversial di dunia.
